Privacy Policy

507 Aviation Ltd. (“507 Aviation,” “we,” “us,” or “our”) operates the 507 Aviation Pilot rating and review platform (the “Platform”). This Privacy Policy describes how we collect, use, disclose, and retain personal information from helicopter pilots who create profiles on the Platform (“Pilots”) and from subscribers who access the Platform to view Pilot profiles and submit ratings and reviews (“Subscribers”).
 

This Privacy Policy is incorporated by reference into both the Pilot Terms of Service and the Subscriber Terms of Service (together, the “Terms”). By using the Platform, you consent to the practices described in this Privacy Policy. Capitalized terms used but not defined in this Privacy Policy have the meanings given to them in the applicable Terms.

This Privacy Policy is governed primarily by the Personal Information Protection Act (Alberta) (“PIPA”), which applies to the collection, use, and disclosure of personal information that occurs within Alberta. To the extent that personal information crosses provincial or national borders in connection with the Platform, and the access of the Platform by Pilots and Subscribers located outside Alberta, the Personal Information Protection and Electronic Documents Act (Canada) (“PIPEDA”) also applies. We are committed to complying with all applicable privacy legislation in our collection, use, and disclosure of personal information.

 

1.Information We Collect
 

1.1Information Collected from Pilots.

When a Pilot creates and maintains a profile on the Platform, we collect the following personal information:

 

(a)full legal name;

(b)helicopter Pilot license number and type;

(c)certifications and ratings;

(d)helicopter types flown;

(e)geographic regions of operation;

(f)professional photograph or headshot;

(g)brief professional biography; and

(h)any other information as determined by 507 Aviation from time to time to support the purpose of the Platform.

 

We also collect updates that Pilots are required to provide during the term of their active profile, including notifications of changes to licensing or certification status and disclosures of material aviation accidents, incidents, or regulatory safety violations. All Pilot profile information is displayed on the Platform and made available to Subscribers for the purposes described in Section 4 of this Privacy Policy.

1.2Information Collected from Subscribers.

When a Subscriber registers for and uses the Platform, we collect the following personal information:

 

(a)full legal name or, if registering as an entity, the full legal name of the organization and the name of the authorized representative;

(b)email address;

(c)phone number;

(d)company name (if provided by the Subscriber);

(e)city of residence;

(f)professional role or affiliation with the aviation industry; and

(g)any other information as determined by 507 Aviation from time to time to support the purpose of the Platform.

 

For Corporate Subscribers, we also collect the names and email addresses of all authorized users registered to the corporate account.

1.3Ratings and Reviews.

We collect all ratings and reviews submitted by Subscribers through the Platform, including the content of the rating or review, the rating score, the date of submission, and, where the Subscriber has not elected to submit anonymously, the identity of the submitting Subscriber. Where a Subscriber elects to submit anonymously, their identity is retained internally by 507 Aviation for moderation and abuse-detection purposes but is not disclosed to the rated Pilot or other Subscribers, except as required by law or in response to valid legal process.

1.4Payment Information.

Subscription fees are processed through Stripe, Inc. (“Stripe”), a third-party payment processor headquartered in the United States. By submitting payment information through the Platform, you acknowledge that your personal information will be transferred to and processed in the United States for the purpose of processing your subscription payment and managing your billing cycle. 507 Aviation does not collect, store, or retain your credit card number, bank account information, or other payment credentials. All payment information you provide is submitted directly to and processed by Stripe in accordance with Stripe’s own Privacy Policy and Terms of Service. We receive only limited transactional data from Stripe, such as confirmation of payment, the amount charged, and the billing period, for the purpose of managing your subscription. We encourage you to review Stripe’s Privacy Policy at stripe.com/privacy before submitting payment information.

1.5Automatically Collected Information.

When you access or use the Platform, we may automatically collect certain technical and usage information, including your IP address, browser type and version, device type, operating system, pages viewed, links clicked, and the date and time of your visit. This information is used for Platform security, performance monitoring, and analytics purposes and is not used to identify individual users unless required for abuse detection or to respond to a security incident. We use cookies and similar tracking technologies to collect this information. You may control or disable cookies through your browser or device settings; however, please note that disabling cookies may affect the availability or functionality of certain features of the Platform.

2. How We Obtain Consent.

We obtain your consent to the collection, use, and disclosure of your personal information in the following ways:

(a)Express Consent: by completing the registration process and accepting the applicable Terms of Service, you expressly consent to the collection, use, and disclosure of your personal information as described in this Privacy Policy; 

(b)Electronic Consent: where required, consent is obtained through electronic acknowledgment, including checkboxes or electronic signature on registration and account creation forms presented through the Platform; and

(c)Implied Consent: by accessing and using the Platform, you consent to the collection and use of your personal information for the purposes described in this Privacy Policy and as reasonably necessary to provide you with the services you have requested. Where we intend to collect, use, or disclose your personal information for a new purpose not contemplated by this Privacy Policy, we will seek your consent in advance of doing so.

3.How We Use Personal Information

3.1Pilot Information.

We use personal information collected from Pilots to:

(a)create, display, and maintain Pilot profiles on the Platform for access by Subscribers;

(b)operate and administer the Platform, including technical infrastructure, search functionality, caching, backup, and security purposes;

(c)aggregate, anonymize, and analyze profile data and ratings for Platform improvement, analytics, research, and business intelligence purposes;

(d)communicate with Pilots regarding their profiles, account status, licensing update obligations, and Platform changes;

(e)enforce the Pilot Terms of Service and investigate violations of the Pilot Code of Conduct;

(f)with the Pilot’s express written consent, feature the Pilot’s profile, name, photograph, or testimonials in marketing and promotional materials; and

(g)use aggregated, non-identifying information in marketing materials and promotional content.

3.2Subscriber Information.

We use personal information collected from Subscribers to:

(a)create and administer Subscriber accounts and manage subscription tiers;

(b)process and manage subscription payments through Stripe;

(c)provide Subscribers with access to Pilot profiles, credentials, ratings, and reviews;

(d)moderate ratings and reviews submitted by Subscribers and detect and investigate abuse or bad-faith submissions;

(e)communicate with Subscribers regarding their accounts, subscriptions, and Platform changes; and

(f)enforce the Subscriber Terms of Service and investigate violations of the Acceptable Use Policy.

3.3Aggregated and Anonymized Data.

We may aggregate and anonymize personal information collected from both Pilots and Subscribers for analytics, Platform improvement, research, and business intelligence purposes. Anonymized and aggregated data does not identify any individual and may be used and disclosed without restriction. Any anonymization of personal information is carried out in accordance with applicable privacy legislation.

4.Disclosure of Personal Information

4.1Pilot Information.

Pilot profile information, including full legal name, license number and type, certifications and ratings, helicopter types flown, geographic regions of operation, professional photograph, and professional biography, is displayed on the Platform and made available to all registered Subscribers for the purpose of facilitating informed decisions regarding helicopter Pilot services. This disclosure is authorized by the Pilot's express consent provided upon profile creation under the Pilot Terms of Service. We do not sell, rent, or otherwise disclose Pilot personal information to any third party for commercial purposes, except as required by law or as described in this Privacy Policy.

4.2Subscriber Information.

Subscriber personal information is not displayed on the Platform to other Subscribers or to Pilots, except to the extent that a Subscriber’s identity is visible in connection with ratings or reviews they submit where the Subscriber has not elected to submit anonymously. We do not sell, rent, or otherwise disclose Subscriber personal information to any third party for commercial purposes, except as required by law or as described in this Privacy Policy.

4.3Legal Requirements.

We may disclose personal information where required by applicable law, court order, or valid legal process, including in response to requests from law enforcement, aviation authorities, or regulatory bodies. We may also disclose personal information where we believe in good faith that such disclosure is necessary to protect the rights, property, or safety of 507 Aviation, its users, or the public.

4.4Business Transactions.

In the event of a merger, acquisition, corporate restructuring, financing, or sale of all or substantially all of 507 Aviation’s assets or business, personal information held by 507 Aviation may be transferred to the acquiring or successor entity as part of that transaction. We will provide notice of any such transfer in accordance with applicable privacy legislation.

5.Retention of Personal Information

5.1Pilot Information.

Pilot profile information is retained for the duration of the Pilot’s active profile on the Platform. Upon deactivation of a Pilot’s profile, the Pilot’s profile will be removed from Subscriber view and will no longer appear in search results or public listings. 507 Aviation will delete the Pilot’s personal information from its internal systems when it is no longer required for the purposes of Platform operations, legal compliance, dispute resolution, and the survival of obligations under the Pilot Terms of Service. No specific retention period is guaranteed. Deletion will occur as soon as reasonably practicable after personal information is no longer required for these purposes, subject to any applicable legal obligations that may require retention for a defined period. Ratings and reviews submitted by Subscribers in respect of a Pilot will be retained by 507 Aviation as Platform data and may be retained in anonymized or aggregated form indefinitely.

5.2Subscriber Information.

Subscriber personal information is retained for the duration of the Subscriber’s active account on the Platform. Upon cancellation or termination of a Subscriber’s account, 507 Aviation will delete the Subscriber’s personal information from its internal systems when it is no longer required for the purposes of legal compliance, dispute resolution, and the survival of obligations under the Subscriber Terms of Service. No specific retention period is guaranteed. Deletion will occur as soon as reasonably practicable after personal information is no longer required for these purposes, subject to any applicable legal obligations that may require retention for a defined period. Subscribers are reminded of their obligation under the Subscriber Terms of Service to permanently delete all Pilot profile information obtained through the Platform within thirty (30) days of account termination.

 

 

6.Your Rights Regarding Personal Information

6.1Access and Correction.

Subject to applicable law, you have the right to request access to the personal information we hold about you and to request that any inaccurate, incomplete, or outdated personal information be corrected. To submit an access or correction request, please contact us at reviews@507aviation.com. We will respond to all access and correction requests within thirty (30) days of receipt, or such other period as may be permitted under applicable privacy legislation.

6.2Deletion Requests.

You may request the deletion of your personal information by contacting us at reviews@507aviation.com. We will process deletion requests in accordance with applicable privacy legislation. Please note that we may be required to retain certain personal information for legal, regulatory, or operational purposes, including to fulfill our obligations under the Terms and to respond to any outstanding disputes or claims. Deletion of your personal information will not affect the retention of anonymized or aggregated data derived from your information.

6.3Withdrawal of Marketing Consent.

Pilots who have provided express written consent to the use of their profile, name, photograph, or testimonials in marketing or promotional materials may withdraw that consent at any time by contacting reviews@507aviation.com. If you have opted in to receive marketing or promotional email communications from us, you may also unsubscribe at any time by clicking the unsubscribe link included in any such communication. Upon receipt of a withdrawal or unsubscribe request, we will cease new marketing uses of your personal information within thirty (30) days. Marketing materials already distributed prior to the withdrawal of consent may remain in circulation.

7.Withdrawal of Consent.

Subject to applicable law and any contractual or legal obligations, you may withdraw your consent to our collection, use, or disclosure of your personal information at any time by contacting us at reviews@507aviation.com. Please note that withdrawal of consent may affect our ability to provide you with access to the Platform or certain features thereof, and we will advise you of the consequences of withdrawal before processing your request. Withdrawal of consent does not affect the lawfulness of any collection, use, or disclosure carried out prior to the withdrawal.

8.Privacy Complaints.

If you have concerns or questions about our personal information handling practices, or believe that we have not complied with this Privacy Policy or applicable privacy legislation, you may submit a complaint to our Privacy Officer at reviews@507aviation.com. We take all privacy complaints seriously and will acknowledge receipt of your complaint promptly. We will investigate all complaints and respond with the outcome of our investigation within thirty (30) days of receipt, or such longer period as may be reasonably necessary given the complexity of the complaint. Where a complaint is found to be justified, we will take the steps necessary to remedy the issue and will inform you of those steps. If you are not satisfied with our response, you may have the right to refer the matter to the Office of the Information and Privacy Commissioner of Alberta (“OIPC”) at www.oipc.ab.ca, or, where PIPEDA applies, to the Office of the Privacy Commissioner of Canada at www.priv.gc.ca.

 

 

 

9.Security of Personal Information

We implement reasonable administrative, technical, and physical safeguards to protect the personal information we hold against unauthorized access, use, disclosure, alteration, and destruction. However, no method of transmission over the internet or method of electronic storage is completely secure. We cannot guarantee the absolute security of your personal information and are not responsible for unauthorized access to or disclosure of your personal information resulting from circumstances beyond our reasonable control, including cyberattacks, data breaches caused by third parties, or failures of third-party infrastructure. In the event of a privacy breach involving personal information under our control where a reasonable person would consider that there exists a real risk of significant harm to an individual as a result of the loss, unauthorized access, or disclosure, we will notify the Office of the Information and Privacy Commissioner of Alberta (the “OIPC”) without unreasonable delay in accordance with section 34.1 of PIPA. Where directed by the OIPC, or where we determine it is appropriate to do so, we will also notify affected individuals of the breach. You are also responsible for maintaining the security of your own account. You should keep your account credentials confidential, use a strong and unique password, and not share your login information with any other person. You should log off your account and close your browser window when you have finished your session, particularly if you are using a shared or public device. If you become aware of any unauthorized access to your account or personal information, please notify us immediately at reviews@507aviation.com.

10.Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or Platform functionality. For material changes to this Privacy Policy, we will provide notice by email to the address associated with your account at least thirty (30) days before the changes take effect. For non-material changes, we may implement changes immediately upon posting to the Platform. Your continued use of the Platform after any changes to this Privacy Policy take effect constitutes your acceptance of the revised Privacy Policy.
